Electronic mail (e-mail) notification

ELECTRONIC MAIL (E-MAIL) NOTIFICATION FOR LEGAL PURPOSES

1. APPLICATION

1.1 This e-mail notification (Notification) is legally enforceable and binding on the recipient/addressee of any and all e-mail communication which was sent from communication facilities of Salman Maktab.

1.2 This Notification shall at all times take precedence over any other e-mail legal notice or disclaimer(s) received by employees, officers, representatives or contractors utilising communications facilities of Salman Maktab.

2. CONTRACTUAL ARRANGEMENTS

2.1 Any agreements (or amendments of agreements) arranged with Salman Maktab through the use of any such electronic correspondence shall only come into effect once Salman Maktab indicated such contract formation in a follow up or return hard copy communication on a Salman Maktab letterhead and signed by a duly authorised representative.

2.2 No warranties are made or implied that any employee and/or contractor of Salman Maktab is authorised to create or authorised to send this communication.

2.3 Return e-mail blocked by Salman Matab virus detection software and/or filtering applications shall not be deemed to have been received by Salman Maktab and/or the addressee.

2.4 No e-mail correspondence sent to Salman Maktab shall be deemed to have been received until Salman Maktab has responded to the said correspondence. An auto-reply, or "out-of-office" notification shall not constitute such “response” for purposes of this clause.

3. CONFIDENTIALITY

3.1 This e-mail transmission contains confidential information, which is the property of Salman Maktab. Unauthorised disclosure and/or use may result in civil and criminal liability. No person, other than the recipient (unless indicated by the sender) may use or disclose the contents of this message, links or attachments to this document, to any person whatsoever.

3.2 The contents of this e-mail, including any attachments, are intended solely for the use of the individual or entity to whom they are addressed. If you are not an intended recipient, please contact us immediately by return e-mail and then delete both messages. You may not otherwise read, forward, copy, use or disclose this e-mail or any attachments. At no time may you act on the information contained therein.

4. DISCLAIMER, LIMITATION AND LIABILITY

4.1 Under no circumstances shall Salman Maktab or the sender of this e-mail be liable to any party for any direct, indirect, special or consequential damages, including, without limitation, any loss of profits, business interruption, loss of programs or other data on information handling systems or otherwise, even if Salman Maktab or the sender of this e-mail have been expressly advised of the possibility of such damages.

4.2 Any views expressed in this e-mail are those of the individual sender except where the sender expressly, and with authority of Salman Maktab, states otherwise. If this e-mail message is used for purposes unrelated to the official business of Salman Maktab, Salman Maktab shall not be liable for any damage liability, infringement or loss caused by the contents of this message and the sender shall take full responsibility therefore in his/her sole and personal capacity. It is your responsibility to check any attachments for viruses or defects before opening or sending them on, with permission. None of the sender or Salman Maktab accept any liability for any consequential damage resulting from this email containing computer viruses.

5. COPYRIGHT

5.1 Salman Maktab retains the copyright to all e-mail messages and attachments sent from its communications systems to the extent that such content is original, subject to copyright and owned by Salman Maktab by operation of law. The recipient / addressed is hereby licensed to open and read the message links and/or attachments only – all other rights are reserved unless so indicated by the sender or Salman Maktab.

5.2 The e-mail address of the sender may not be used, copied, sold, disclosed, shared in any manner or be incorporated into any database or mailing list for spamming and/or marketing practices and/or other purposes without the prior consent of the sender and/or Salman Maktab.

5.3 To the extent permitted by law, Salman Maktab reserves the right to intercept, filter, view, block, delete, access, copy, read and act upon this e-mail message and all e-mail messages sent as reply messages to this e-mail message or otherwise sent to the address of the sender.
